A typical definition of abrogation found in the jurisprudence literature is "the (heavenly) replacement of one juridical ruling with a later ruling." This book surveys the subject of abrogation (naskh) in the Quran, hadith, and Islamic literature, illustrating that the concept of abrogation was introduced after the prophetic era in order to explain certain verses of the Quran and what has come to be termed as conflicting prophetic narrations (mukhtalaf al-hadith). It goes on to suggest that the abrogated rulings were merely pre-Islamic cultural practices that contradicted Islamic principles. Furthermore, the book argues that the Quranic verses and prophetic narrations that were misperceived as conflicting should be contextually situated and applied according to the wisdom behind them, with the practical implication being the validation of all Quranic verses and (authentic) prophetic instructions, regardless of their perceived contradictions, allowing Islamic jurisprudence to retain its flexibility within changing circumstances.

During the formative classical period of Islamic jurisprudence, well-known scholars possessed not only the intellectual skills required for analytic reasoning but also a broad general knowledge of the fields relevant to the cultural contexts in which they issued their edicts. A viable fatwa requires knowledge of the Shari‘ah as well as local customs, cultural realities, individual and communal implications, and related matters. The original juristic tradition was formulated and fixed during the first three Islamic centuries, a time of widespread sociopolitical turmoil. Of course, the jurists’ legal outlooks and thinking processes could not have escaped this reality. While Muslims of the prophetic and Râshidûn periods adhered closely to the authentic texts due to their sincerity, piety, prophetic training, and proximity to the revelation, the changing environment in which their descendants functioned gradually started to impact how the authentic texts were understood, interpreted, paraphrased, and implemented. Both the Muslim and the non-Muslim worlds have drastically changed since that time. The new geopolitical and scientific realities of our rapidly changing world demand a fresh look at some aspects of the established juristic tradition. The way forward involves a systematic fresh look at and reevaluation of the old fatwas, as well as the issuance of new ones with a maqâsidî outlook that can deal successfully with today’s ever-changing global realities. In this edited volume, papers on fatwa and iftâ’ point to an approach that is both rooted in the Islamic legacy and committed to meeting the challenges of the modern world.

The reform in higher education in Muslim societies is in sum a paradigm shift in perspective driven by important considerations including the aims of education itself. It may require reforming existing disciplines and inventing new ones, as well as working in conjunction with current knowledge and discourses by taking effective account of the ethical, spiritual norms of Muslim society and the guiding principles that it operates under, which in turn mark the underlying basis of its makeup and spiritual identity. Rather than creating divisions, reform of higher education in Muslim societies recognizes the plurality and diversity of the modern networked world, and seeks to replace sterile and uniform approaches to knowledge with a broader and more creative understanding of reality as lived on different soils and different cultures. Moderation, balance, and effective communication are paramount features of the underlying philosophy.

Since the publication of Samuel Huntington’s The Clash of Civilizations, concern about civilization has been reintroduced into the debate on the world order. Malek Bennabi (1905–1973), prominent Algerian thinker and great Muslim intellectual, intently focused on unraveling the causes of Muslim decline and the success of Western civilization and culture. The key problem he theorized lay not in the Qur’an or Islamic faith but in Muslims themselves. The author investigates Bennabi’s approach to civilization and the fundamental principles drawn, using metatheorizing methodology. In doing so he sheds further light on perhaps one of the more intriguing elements of Bennabi’s theory, that civilization is governed by internal-external and social-intellectual factors and that an equation can be generated for civilization itself. This equation of Man+Soil+Time = Civilization and of which religion, according to Bennabi, forms the all-important catalyst, is explained and its significance in terms of the reversal of Muslim decline evaluated. What is clearly apparent is that for Bennabi, Man is the central force in any civilizing process and without him the other two elements are of no value. With regard to outcomes, Bennabi’s unerring conviction that unless Muslims changed their spiritual condition they could not affect any far-reaching, meaningful change in society is echoed in the Qur’anic verse: “Verily, never will Allah change the condition of a people until they change what is in themselves” (13:11).
